Executive Summary


ANNOUNCEMENT: The Department of State will release an addendum to this report in mid 2021 that expands the subsection on Women in Section 6 to include a broader range of issues related to reproductive rights.​


Armenia’s constitution provides for a parliamentary republic with a unicameral legislature, the National Assembly (parliament). The prime minister, elected by parliament, heads the government; the president, also elected by parliament, largely performs a ceremonial role. During 2018 parliamentary elections, the My Step coalition, led by Acting Prime Minister Nikol Pashinyan, won 70 percent of the vote and an overwhelming majority of seats in parliament. According to the assessment of the international election observation mission under the umbrella of the Organization for Security and Cooperation in Europe, the parliamentary elections were held with respect for fundamental freedoms.

The national police force is responsible for internal security, while the National Security Service is responsible for national security, intelligence activities, and border control. The Special Investigative Service (SIS) is a separate agency specializing in preliminary investigation of cases involving suspected abuses by public officials. The Investigative Committee is responsible for conducting pretrial investigations into general civilian and military criminal cases and incorporates investigative services. The National Security Service and the police chiefs report directly to the prime minister and are appointed by the president upon the prime minister’s recommendation. The cabinet appoints the heads of the Special Investigative Service and Investigative Committee upon the prime minister’s recommendations. Civilian authorities maintained effective control over the security forces. Members of the security forces committed some abuses.

During 44 days of intensive fighting from September 27 to November 10 involving Armenia, Armenia-supported separatists, and Azerbaijan, significant casualties and atrocities were reported by all sides. After Azerbaijan, with Turkish support, re-established control over four surrounding territories controlled by separatists since 1994, a Russian-brokered ceasefire arrangement announced by Armenia and Azerbaijan on November 9 resulted in the peaceful transfer of control over three additional territories to Azerbaijan, as well as the introduction of Russian peacekeepers to the region. Since 1995 the final status of Nagorno-Karabakh has been the subject of international mediation by the cochairs of the Organization for Security and Cooperation in Europe’s Minsk Group (the United States, France, and Russia). There was also an outbreak of violence with casualties along the international border between Armenia and Azerbaijan near Tavush from July 12 to July 16. Following the September 27 outbreak of hostilities, the government declared martial law under which restrictions were imposed on freedoms of expression, assembly, and movement. The restrictions were lifted December 2, and only provisions for partial mobilization of troops remained in effect at year’s end. Significant human rights issues included: torture; arbitrary detention, although with fewer reports than in 2019; harsh and potentially life-threatening prison conditions; serious problems with judicial independence; arbitrary interference with privacy; trafficking in persons; crimes involving violence or threats of violence targeting civil society figures and lesbian, gay, bisexual, transgender, or intersex persons; and use of the worst forms of child labor. Significant human rights issues connected with the Nagorno-Karabakh armed conflict included unlawful killings and civilian casualties.

The government took steps to investigate and punish alleged abuses by former and current government officials and law enforcement authorities. For example, throughout the year, an investigation continued into the culpability of former high-ranking government officials surrounding events that led to the deaths of eight civilians and two police officers during postelection protests in 2008.

«Սասնա ծռեր»-ը դատապարտվեցին, ապստամբելու իրավունքը հաշվի չառնվեց

     110-ից ավելի նիստ,  երեք ու կես տարուց ավելի դատաքննություն․ ճիշտ այսքան տեւեց ոստիկանության ՊՊԾ գունդը գրաված «Սասնա ծռեր» 1-ի գործով դատաքննությունը։

  Փետրվարի 24-ին հրապարակված դատավճռով դատավոր Մեսրոպ Մակյանը    «Սասնա ծռեր» 1-ի գործով անցող բոլոր 9 անդամներին մեղավոր ճանաչեց նրանց առաջադրված մեղադրանքներում։ Միաժամանակ դատավորն  արդարացրեց ոստիկան Գագիկ Մկրտչյանի սպանության մեջ մեղադրվող Արմեն Բիլյանին՝ ապացույցների բացակայության հիմքով։  Հիշեցնենք, ՊՊԾ գնդի գրավման ժամանակ  երեք ոստիկանների՝ Գագիկ Մկրտչյանի, Արթուր Վանոյանի եւ Յուրա Տեփանոսյանի սպանության հոդվածով մեղադրանք էր առաջադրվել Արմեն Բիլյանին եւ Սմբատ Բարսեղյանին։  

     Դատավոր Մեսրոպ Մակյանն ապացուցված համարեց երկու ոստիկանի՝ Արթուր Վանոյանի եւ Յուրա Տեփանոսյանի սպանության մեջ Սմբատ Բարսեղյանի մեղքը եւ նրան դատապարտեց 25 տարվա ազատազրկման։

 Սակայն «Սասնա ծռեր»-ը բազմիցս պնդել են՝ իրենք ոստիկաններ Յուրա Տեփանոսյանի եւ Գագիկ Մկրտչյանի մահվան հետ կապ չունեն, ապացույցներն առկա են, իսկ Արթուր Վանոյանի մահը փոխհրաձգության արդյունքում է եղել։

  Դատավոր Մեսրոպ Մակյանը որոշեց  Գագիկ Մկրտչյանի գործը վերադարձնել դատախազին՝ նրա սպանության հանգամանքները պարզելու նպատակով։

   «Սասնա ծռեր»-ի մյուս անդամները՝ Պավել Մանուկյանը, Վարուժան Ավետիսյանը, Մխիթար Ավետիսյանը, Գագիկ Եզիազարյանը, Արեգ Կյուրեղյանը,  Սեդրակ Նազարյանը եւ Էդվարդ Գրիգորյանը, մեղավոր ճանաչվեցին  մի խումբ անձանց կողմից ապօրինի կերպով զենք, ռազմամթերք, պայթուցիկ նյութեր կամ պայթուցիկ սարքեր ձեռք բերելու, հափշտակելու, պատանդ վերցնելու, գույքը դիտավորությամբ ոչնչացնելու, շենքեր, շինություններ, տրանսպորտի, հաղորդակցության կամ կապի միջոցներ զավթելու համար։

 Պավել Մանուկյանը եւ Սեդրակ Նազարյանը դատապարտվեցին 10, Վարուժան Ավետիսյանը, Մխիթար Ավետիսյանը, Գագիկ Եղիազարյանը եւ Արմեն Բիլյանը դատապարտվեցին 9 տարի 6 ամսվա, Արեգ Կյուրեղյանը 9  տարի 6 ամսվա, իսկ Էդվարդ Գրիգորյանը՝ 8  տարի  6 ամսվա ազատազրկման։

   Արայիկ Խանդոյանի նկատմամբ քրեական հետապնդումը դադարեցվեց մահվան հիմքով։  

  Ի դեպ, «Սասնա ծռեր»-ը կարող էին օգտվել նաեւ համաներման իրավունքից,  սակայն  դա եւս չտարածվեց նրանց վրա։ Որոշվել էր՝  Երեւանի 2800-ամյակին եւ Առաջին Հանրապետության 100-ամյակի կապակցությամբ 2018թ․ հայտարարված համաներմանը  «Սասնա Ծռերի» գործով պետք էր հաշվի առնել տուժողների կարծիքը։ Անկախ Հայաստանի  պատմության մեջ  մինչ այդ կիրառված  10 համաներումների ժամանակ  տուժողների կարծիքը երեբեւէ  հաշվի չէր առնվել։  Համաներման դեմ առարկել էին գործով տուժող ոստիկանններ, իսկ ահա մյուս տուժողները առարկություն չէին հայտնել։ Որքան էլ որ տարօրինակ է, նույն տուժող ոստիկանները առարկություն չեն հայտնել գործից անջատված մասով համաներում կիրառելուն։ 

   «Սասնա ծռեր»-ը դատաքննության ողջ  ընթացքում պնդում էին՝ օգտվել են ապստամբելու իրենց  իրավունքից, քանի որ իշխանությունը յուրացված էր։
